    The “necessary and proper” clause (Article I, Section 8) grants Congress the authority to create laws that are not explicitly in the Constitution. This has always been the case. Further, as the head of the executive branch, it is the privilege of the President of the United States to declare executive orders to any and all agencies of the federal governments. Executive orders have been issued by ALL U.S. presidents since George Washington in 1789.
